This thesis examines the suspension of an employment contract as a distinct institution, characterized by the temporary halt of the employment function without termination of the contract, with automatic restoration once the specified period expires. The paper highlights its differences from the modification and termination of an employment contract, and analyzes how this institution is reflected in the current Labor Code not as a unified concept, but in a fragmented form. Based on the practical needs of small business entities and the experience of Moldova and Romania, proposals are made regarding the necessity of regulating it as a separate provision in legislation.
